PFAS and the States
A recent meeting of the Environmental Protection Agency concerning its plan to rescind and reconsider the landmark drinking water standard on PFAS set under the Biden Administration saw complaints about the regulations from state officials and industry representatives. There is a lack of clarity on what the EPA will do with the standard, putting the states in an awkward position, as many states of laws that say their drinking water standard cannot be stricter than federal law. Despite this uncertainty, there has been a huge legislative push on the state level, to address PFAS contamination by limiting their use in products, setting a maximum level in drinking water, and creating plans to clean up contamination. Many see state legislation as the last line of defense in protecting residents from this dangerous contamination.
